General Terms and Conditions
These Terms and conditions are an integral part of the rental agreement for any rental of an apartment for a period of more than 1 month. For a rental of less than 1 month , no form is prescribed. In that case the contract is concluded from the acceptance by a party of an offer given by another party.
Except derogations expressly recognized and approved in writing by the lessor, and independent what the contract-, reservation or other usual terms and conditions are of the customer, only these General terms and conditions makes an integral and indivisible part of all operations, services and /or agreements of, with and/or between , Canal Properties NV, hereinafter known as the landlord and the counterparty, in a broad sense, hereinafter referred to as the customer.
Consequently and without exception, all mutual agreements are only binding , if they are mutually confirmed by letter or by mail in writing. Each allowable deviation in condition ,approved by the landlord, doesn’t change anything to the other conditions and is of strict interpretation.
2. Payment terms and conditions
An invoice is only sent to the customer if requested, barring when issuing an invoice is required by law. The landlord has the option of a full or partial pre-payment. In particular, in case of renting for a period of more than 1 month, the first month rent needs to be paid in advance, so for check in.
To hire for a period less than a month, an amount is to be paid before arrival and in accordance with the following schedule :
- Payment must be made 2 days before arrival for bookings of 1 to 6 nights
- Payment must be made 5 days before arrival for bookings of 7-14 nights
- Payment must be made 10 days before arrival for bookings of 15-28 nights
If payment is not made before arrival, the reservation will be canceled automatically. Bookings made less than 5 days prior to arrival must be paid directly by valid credit card and issued by a reputable institution.
Additional services will need to be paid on departure to the person who will inspect the apartment. A valid credit card will be asked as a guarantee for payment of these additional services.
In all other cases the invoices are payable on issue date of the invoice without discount. In the event that the invoice is not fully paid after 30 days, In case of non-payment the price will be increased by operation of law with a compensation fee of 15% with a minimum of EUR 50 and a maximum of 1250 euro. Interests and damage fee are due to the single fact of lack of payment. Payments after expiring date shall be charged first on interest and damage fee, only then on the invoice price. In no circumstance an incomplete and/or contested stay and/or reservation and/or service by the customer be the pretext for a delay in the payment. Any delay in the payment allows the landlord to revoke unilaterally and without compensation all existing and not yet executed agreements as well as stop all current agreements.
The payments shall be made in the currency of the country where the apartment is located, being Belgium, so in EUR (€).
The descriptions, sizes and colors, as well as details of photos and /or drawings in the quotations and/or catalogs, are purely informative and never binding.
4. Electronic telecommunications and Check-in and check-out
When you visit this website or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site www.michaelsresidence.be. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
The reserved stay is available to the customer at the time that was agreed by mail with the customer. If a customer, with a guaranteed reservation, do not arrive at the agreed time, the landlord has the right to charge the customer a compensation charge as provided for in Article 10, on the one hand, and to put an end to the relevant, possibly longer term contract at the other hand.
The customer need to report any complaint relating to stay, goods and/or invoice as soon as possible during his stay to the lessor, in order to provide the landlord to offer the opportunity to resolve the complaint directly.
In each case the complaint can be carried out, on penalty of nullity, within eight days after the delivery, service and/or invoice, by registered letter to or against a receipt of the landlord.
6. In cases of force majeure
In case of force majeure, unforeseeable events independently of its will and/or exceptional circumstances, the landlord reserves the right to change the customer, without any form of compensation, to a colleague, preferable in the surroundings.
All damage caused by the customer, on the apartements or on goods in the apartements, belonging to the Landlord or belonging of third parties with whom the landlord has relationships, the customer needs to be pay the landlord , in accordance with the accepted indication a damage fee, and this at the latest before the departure of the customer. Related to the vehicles parked in the garage boxes of the landlord, as well as installations belonging to third parties with whom the landlord has relations, it is agreed that the landlord is discharged of any responsibility, of any cause such as, without restrictions, damage, theft and/or the disappearance of the vehicle and/or belonging laying in the vehicles as well as for example physical injury to customers or third parties which would have been caused by who/whatever in these places.
8.breach of contract
Any heavy or repeated infringement of the contractual obligations entitles the suffering damage party the right to the immediate termination of the contract without notice.
In any dispute, wherever the operation, service or agreement is executed, only the courts of Ghent are qualified and this in accordance with the Belgian Law. The customer accepts these terms and conditions at the time of reservation, or at the latest at the entry on the day of arrival. The customer confirms to know, understand and agree these conditions, and also to respect the usual rules and instructions the staff of the landlord provides.
10. Cancellation conditions
In case the length of hire is less than a month and a cancellation is done less than 24 hours prior to arrival, until at the latest 12 hours one day prior to arrival, a cancellation fee will be charged of
1 night of 100 % if the stay was scheduled for max 6 days
2 nights to 100% if the stay was scheduled between 7 and 14 days
6 nights at 100% if the stay was scheduled between 15 days and 30 days .
In the event of no-show the total price of the reservation will be charged.
In the case of renting of more than a month , the cancellation conditions are applicable as stated in the rental agreement.
